  • Agreement & Scope: By purchasing or accessing our tools, you agree to these terms. These Services are defined as an "Automated Diagnostic Engine"; they do not constitute legal, tax, or financial analysis.

  • Web Accessibility Commitment: KCAdvocate is committed to ensuring digital accessibility for individuals with disabilities. We continually improve the user experience for everyone and apply relevant accessibility standards to ensure our Zite portal, Fillout intake forms, and digital assets strive to align with WCAG 2.1 Level AA guidelines.   • Electronic Contracting & Consent: By clicking to purchase, accessing our portal, or submitting information through our Fillout forms, you acknowledge and agree that your electronic submission constitutes your legal signature and agreement to these Terms of Use. You agree that electronic records satisfy any legal requirement that communications be in writing, pursuant to the Ohio Uniform Electronic Transactions Act.

  • Sales Tax and Digital Goods Compliance: Because our services and digital products are distributed online to customers within the United States, applicable state and local sales taxes or digital goods taxes may be calculated and charged at checkout based on your state of residence. All financial transactions are processed securely via Stripe, and you agree to pay any applicable taxes as required by your local jurisdiction.

  • License to Use: Your purchase grants you a personal, non-transferable license to use these digital tools for your individual events.

  • Prohibited Uses: To protect our proprietary data, you are strictly prohibited from reproducing, modifying, distributing, or commercially exploiting any template, checklist, or guide. You may not share your access, outputs, or proprietary scripts with any third party, including friends, family, or other vendors.

  • Intellectual Property: All content—including the ebook, templates, and "logic engines"—is the proprietary property of KCAdvocate. Accessing them does not transfer ownership or copyright to you.

  • Intellectual Property Infringement Notice: We respect the intellectual property rights of others. If you believe that any content, template, or digital asset on our platform has been copied or used in a way that constitutes copyright infringement, please notify our designated security contact at [email protected]. Your notice must include: (a) a physical or electronic signature of the person authorized to act on behalf of the copyright owner; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material that is claimed to be infringing and where it is located on our platform; (d) your address, telephone number, and email address; and (e) a statement by you that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.

  • User Inputs & Data License: You retain ownership of the raw personal or event data you input into our diagnostic quizzes. However, by submitting data, you grant KCAdvocate a worldwide, royalty-free, perpetual license to use, store, and aggregate anonymized quiz responses and input metrics for the purpose of improving, training, and maintaining our automated logic engines and diagnostic tools.

  • No Guarantees: You are buying diagnostic tools and templates. These do not guarantee a specific performance outcome or contract result. We provide the data; you make the decision.

  • No Refunds: As these are digital assets that provide instant, lifetime-value data upon purchase, all sales are final. In accordance with the Ohio Consumer Sales Practices Act, the digital nature of our goods and our strict "No Refunds" final sale policy are prominently disclosed prior to purchase on our checkout and product pages. By completing your transaction, you acknowledge and agree that access to these digital assets is final upon instant delivery.

  • Digital Delivery Failures & Technical Glitches: Because our products are digital assets providing instant-access data, all sales are final. However, if a technical glitch, API timeout, or infrastructure failure prevents you from receiving your portal access or digital assets immediately following a successful purchase, you will not be left stranded. Please contact our support team at [email protected], and we will manually verify your transaction and provision your access within a reasonable timeframe.

  • Limitation of Liability: In no event shall KCAdvocate, its principals, affiliates, or associated parties be liable for any indirect or consequential damages arising from the use of these tools. Our total liability shall not exceed the amount paid for the specific product.

  • Account Access: You are responsible for keeping your login information secure. Do not share your portal access with third parties.

  • Service Availability: While we strive for 24/7 availability, our services rely on third-party cloud infrastructure, secure database hosts, form providers, automated logic processors, and payment gateways. KCAdvocate shall not be held liable or responsible for service interruptions, data synchronization delays, webhook failures, API timeouts, or downtime originating from or caused by these third-party technology partners or internet connectivity issues beyond our reasonable control.

  • Force Majeure: KCAdvocate shall not be liable for any failure or delay in performance under these Terms resulting from acts beyond our reasonable control, including without limitation: acts of God, power failures, failure of third-party telecommunications or cloud infrastructure (including Zite, Make, Stripe, or Zoho outages), cyberattacks, labor disputes, or government restrictions.

  • Software Modification & Updates: We reserve the right at any time to modify, suspend, or discontinue, temporarily or permanently, the digital tools, logic engines, or platform features with or without notice. We shall not be liable to you or to any third party for any modification, suspension, or discontinuance of the services.

  • Accuracy of Input: The accuracy, quality, and relevance of the diagnostic "prescriptions" generated by our automated logic engines are directly dependent on the accuracy, completeness, and honesty of the information you provide during the quiz process. We assume all information provided by you is accurate and rely on that data to generate your results. We are not liable for any discrepancies, errors, or suboptimal outcomes resulting from incomplete or inaccurate information provided by you.

  • Age Restriction: By purchasing our services, you represent that you are at least 18 years of age and possess the legal authority to enter into this agreement.

  • Termination for Cause: We reserve the right to suspend or terminate your access to our portal and tools immediately, without notice, if you breach these terms, engage in unauthorized distribution of our proprietary content, or attempt to reverse-engineer our logic engines.

  • Dispute Resolution: We are committed to transparency and solving problems quickly. If a concern arises, you agree to attempt a good-faith negotiation to resolve the issue directly with us before initiating any formal legal proceedings. If we cannot resolve the issue through direct discussion, we agree to participate in at least one session of mediation before escalating the matter to court.

  • Governing Law and Jurisdiction: This agreement is governed by the laws of the State of Ohio. Any legal proceedings not subject to our mandatory mediation requirement shall be brought exclusively in the courts located in Franklin County, Ohio, provided that nothing in this section shall deprive a consumer of any mandatory statutory rights or local venue protections afforded under the Ohio Consumer Sales Practices Act.

  • Professional Disclaimer: KCAdvocate is not a consulting firm. We are a provider of diagnostic tools, automated templates, and data analysis. We provide the data and tools to help you make informed decisions; we do not provide legal or professional advice. By using our tools, you acknowledge that you are responsible for your own contractual and logistical choices.

Payment Security:
We do not see, store, or process your credit card numbers. All payments are handled directly by Stripe. When you make a purchase, Stripe processes the transaction, and we only receive confirmation that the payment was successful so we can unlock your access to the portal. We receive name, email, and Stripe transaction links.
Data Security & Incident Notification:
While we implement robust administrative, technical, and physical safeguards across our operational stack to protect your personal information, no digital transmission or storage system is 100% secure. In the unlikely event of a security breach that compromises your stored Personally Identifiable Information (PII), we will take prompt corrective action and notify affected users in accordance with applicable state and federal data protection guidelines.
Data Deletion & Platform Dependencies:
You are in control. You have a "Request Deletion" button inside your portal that you can use at any time. If you do not manually request deletion, we automatically purge your Personally Identifiable Information (PII)—such as your name, email, and Stripe transaction links—from our active database every 90 days.
***Please be aware that while we purge your data from our internal records, our partner platforms (like Stripe, Zite, Make, and Fillout) maintain their own records of transactions and account activity to comply with banking and digital security laws.Children's Privacy:
Our services are intended solely for individuals who are at least 18 years of age. We do not knowingly collect, solicit, or maintain personal information from anyone under the age of 18. If we discover that we have inadvertently collected data from an individual under 18, we will promptly delete it.
Financial Transaction & Tax Record Retention:
Notwithstanding our standard 90-day active database PII purge, transaction records, invoices, receipts, and associated billing metadata processed via Stripe are retained in accordance with federal and Ohio state tax, accounting, and legal requirements. Stripe maintains these records independently to comply with applicable financial regulations, anti-money laundering laws, and tax compliance mandate

We use your data to calculate your "prescription," build your reports, and ensure the tools you use are aligned with your event requirements. We do not use your email for marketing, newsletters, or third-party spam.4. Data Access & Correction: You have the right to access and view your active personal data at any time by logging into your secure Zite portal. Because our systems operate on an automated 90-day data purge cycle, we do not maintain permanent historical profile records. If you need to correct, update, or change any of the inputs or data associated with your personalized tools prior to the 90-day cycle, you may do so by completing and submitting a new form submission, which generates a fresh and accurate data record in our database.5. Who Sees Your Data: To keep your system running, we use a specific "stack" of trusted tools to process and store your information: We do not sell your data, and we do not share it with anyone outside of this specific operational stack without your explicit permission.

Data Retention and Deletion
We don't hold onto your personal information (PII) forever. We keep your data clean and secure through two main practices:

  • Automatic 90-Day Cleanup: Any personal information you provide in your active profile—such as your name, email, and transaction history—is automatically wiped out of our main database after 90 days, unless you specifically ask us to keep it or the law requires us to hold it longer.

  • Secure System Backups: Our platform partner, Zite, keeps encrypted backups behind the scenes to keep the portal running smoothly. These secure backups follow strict cloud security guidelines so that old data is safely protected and naturally expires over time.

Security Safeguards
We protect your information behind the scenes using secure, industry-standard technology. This means all data sent between your device and our platform is safely encrypted, our databases are locked down, and only authorized systems can access your details as they move through our portal, automation tools, and main database.

Purpose & Scope: Outlines the structure procedure for detecting, containing, investigating, and recovering from any security incident affecting our SASS portal, customer data, or internal infrastructure.
Authorized Third-Party Providers
To run our platform smoothly and securely, we work with trusted, industry-standard third-party partners. Each provider is carefully chosen and vetted for security compliance to ensure your data stays protected.
Incident Response Phases:
Third-Party Partner Security Issues: If a security issue or data exposure happens with one of the trusted tools we rely on to run our platform (such as Zite, Fillout, Make.com, Stripe, or Zoho Mail), we rely on their official security alerts and updates. As the sole operator, Kellee Anderson will review how the issue affects our portal, take immediate steps to secure our systems, and—if any of your stored personal information is impacted—notify you promptly in accordance with applicable state and federal data protection laws.

  • Step 1: Spotting and Reviewing Issues: If automated monitoring, error logs from Make.com, or user reports flag a security issue, it is logged right away. As the sole operator, Kellee Anderson reviews how serious the issue is (from Low to Critical) within two hours of getting the alert.

  • Step 2: Securing the Systems: We take immediate action to isolate affected systems such as turning off compromised API keys in Make.com, disabling affected user accounts in Zite, or taking specific database connections offline. We also save system logs for security analysis and fix any vulnerabilities.

  • Step 3: Recovery and Review: If needed, we restore systems safely from clean backups. We then review the situation within five business days to find out what caused the issue and put safeguards in place, so it doesn't happen again.

  • Step 4: User Notifications: If a security issue involves unauthorized access to your personal information, affected users and relevant authorities will be notified promptly in accordance with applicable data protection laws.

  • Emergency Continuity: In the event of an unplanned absence, emergency access is securely managed to ensure continuity without ever compromising your portal security or data privacy standards.
